You have 20 days to respond once your lender files a lawsuit to foreclose.
Your lawyer will reply for you and a date for your hearing will be scheduled.
You will have your day in court and the court will decide if your case will be dismissed or that your loan will be foreclosed.
The county sheriff will schedule a public auction if the court rules that your loan will be foreclosed.
The auction will be advertised and your home will be sold to the highest bidder.
If your lender accepts a bid that is less than what you owe, the court may award a deficiency judgment against you.
You may have the right to exercise your statutory redemption rights. Some lenders may even allow you to reinstate your loan during the redemption period. |
